Autor článku se domnívá, že náklady exekučního řízení jsou ve srovnání s náklady nalézacího řízení upraveny velmi kusým způsobem a nezohledňují veškeré procesní situace, k nimž během exekuce může dojít. Proto stávající úpravu pokládá za nevyváženou.

The costs of the distraint on one hand and the costs between the parties to the destraint on the other are regulated by different rules. If we compare these rules to the procedure insitutes regulating decision-making on the compensation of the costs of the participants and the costs of the state within the framework of the finding procedure, they are partial unbalanced to the benefit of the beneficiary.
