The Faculty of Law of the University of West Bohemia in Pilsen would like to invite you to the internation conference
"Old Case Law in the Light of New Laws - System Solution"
which wil take place from 25th until 26th November 2010 in Pilsen.
We are witnessing the ongoing work on new codifications of private law, and also extensive modifications of private law, throughout Europe. It is not just the Dutch Civil Code or Civil Code of the Russian Federation. New Civil Codes are being prepared also in Poland and the Slovak Republic. Let’s not forget the codification efforts at EU level. Recently, a new Civil Code was adopted in Hungary (2009) and Romania (2009). In the Czech Republic, in summer 2009, a proposal for a new Civil Code was submitted to the Chamber of Deputies of the Czech Parliament.
In 2010, Faculty of Law at the University of West Bohemia in Pilsen obtained a grant “Impact of the new Civil Code on the applicability of the present case law of the Supreme Court” (GA ČR P408/10/0461), in terms of which the applicability of the current Supreme Court case law since 1945 after the adoption of the new Civil Code will be primarily examined.
The new codification of private law has a major impact on the daily life of everyone. Legal certainty is affected. Old solutions may not apply anymore, while the new ones are unknown or controversial. The question that arises in terms of the decision-making procedures, regardless the fact that we are living in the continental legal culture, is to what extent the decisions taken in previous years are applicable now and also for situations under the new law.
In connection with the commencement of work on the scientific mission, Faculty of Law at the University of West Bohemia in Pilsen has decided to organize a conference called “Old Case Law in the Light of New Laws – System Solutions“.
Many countries faced or are facing the same problem. The solution is of course the distinction of the newly adopted legislation, the extent to which the legislation reflected the current case law, and the extent to which it calls for new solutions. And there are more possible solutions - a codification reflecting the current case law, an interpretation of the codification in light of the old case law changing its meaning, system solutions in the form of databases and registries, a total discontinuity, etc. Therefore, we welcome experts from various European countries who would actively participate in the conference and share with us their experience with the said issues that they have been solving in connection with their recodifications.
